1. Introduction
Welcome to Evironme, the mobile application of Evironme Limited (the "App"). These Terms & Conditions (the "Terms") govern your access to and use of the App and the services provided through it.
By downloading, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the App.
The App is provided by Evironme Limited, a company incorporated in Nigeria under the Corporate Affairs Commission (CAC), with its principal office at The Ark Tower, 17 Ligali Ayorinde Street, Victoria Island, Lagos State, Nigeria ("Evironme", "we", "us", or "our").
Evironme provides a software platform that enables electric vehicle (EV) drivers to discover Evironme charging locations, initiate and manage charging sessions, monitor energy consumption, and access services provided through the Evironme platform.
2. Eligibility & Account Registration
2.1 Age Requirement
You must be at least 18 years old to use the App. By registering an account, you confirm that you meet this requirement.
2.2 Legal Compliance
You are responsible for ensuring that your use of the App complies with all applicable Nigerian laws, regulations, and any other local requirements that may apply to your use of the App.
2.3 Account Security
You are responsible for safeguarding your login credentials and for all activity conducted through your account. Evironme is not liable for unauthorised access to your account unless caused directly by our negligence or failure to implement reasonable security measures. You must notify us immediately if you suspect any unauthorised use of your account.
2.4 Account Deletion
You may delete your account at any time through the App settings. Account deletion does not affect any outstanding payment obligations, active charging sessions, or data that must be retained to comply with legal, regulatory, accounting, or fraud-prevention requirements.
3. The SPLIT™ Platform & Evironme's Role
3.1 Platform Description
SPLIT™ is Evironme's proprietary charge point management platform. It facilitates access to EV charging services at Evironme-owned and third-party charge points that are connected to and managed through the SPLIT™ platform.
3.2 Charging Infrastructure
Evironme owns and operates a network of EV charging stations across Nigeria. In addition, certain charge points connected to the SPLIT™ platform may be owned and operated by independent third-party Charge Point Operators ("CPOs") who use the SPLIT™ platform under agreement with Evironme.
3.3 Charging Contract
When you initiate a charging session at an Evironme-owned charge point, you are transacting directly with Evironme for the supply of charging services. When you initiate a session at a third-party CPO's charge point, you enter into a direct contract with that CPO for the supply of electricity and charging services. In both cases, Evironme facilitates the session through the SPLIT™ platform as the technical and payment intermediary.
3.4 Interoperability
Charging sessions may depend on communication protocols, network connectivity, and third-party systems. Evironme does not guarantee uninterrupted interoperability between all networks, CPOs, vehicles, or charging hardware at all times.
3.5 Hardware Compatibility
References to "compatible" hardware in the App relate solely to software interoperability and do not constitute a warranty or representation regarding the safety, condition, reliability, or performance of any charging equipment.
4. Charging Information & Accuracy
4.1 Charger Availability
Information regarding charger location, availability, pricing, and charging speed is displayed in the App based on data from Evironme's network and connected CPOs. While we use reasonable efforts to ensure accuracy, Evironme does not guarantee that all chargers will be available, functional, or error-free at all times.
4.2 Tariff Information
Pricing displayed in the App reflects rates set by Evironme or the applicable CPO at the time of display. Rates may be subject to change. The final session cost will be confirmed within the App upon session completion.
5. Pricing, Payments & Invoicing
5.1 Pricing
Charging session prices are displayed in Nigerian Naira (₦) within the App. For Evironme-owned charge points, pricing is set by Evironme. For third-party CPO charge points, pricing is set by the applicable CPO.
5.2 In-App Wallet & Top-Up
The App includes a digital wallet feature that users may top up via supported Nigerian payment methods including Paystack. Wallet balances are used to pay for charging sessions. Wallet balances are non-transferable and non-refundable except where required by law.
5.3 Payment Processing
Payments are processed by licensed third-party payment service providers operating in Nigeria. Evironme is not a bank, payment institution, or electronic money issuer.
5.4 Authorisation Holds
A temporary authorisation hold may be placed on your payment method or wallet balance when initiating a charging session to verify available funds. The final charged amount will be confirmed upon session completion and may differ from the initial hold.
5.5 Receipts & Invoices
Session receipts are generated automatically upon completion of each charging session and are available within the App. Receipts will also be delivered to your registered email address.
6. RFID Access & Evironme Network Card
Certain Evironme charge points require an Evironme Network Card (RFID card) to initiate a session. RFID cards can be registered, activated, and managed through the App. You are responsible for the safekeeping of your RFID card. A lost or stolen card must be deactivated immediately through the App. Evironme reserves the right to charge a replacement fee for lost cards as communicated through the App or our official channels.
7. Referral Programme
Evironme may operate a referral programme through the App whereby users earn charging credits for referring new users who register and complete their first qualifying charging session. Charging credits are applied to the in-app wallet and are redeemable solely for public charging sessions on the Evironme network. Credits are non-transferable, non-cashable, and subject to expiry terms communicated within the App. Evironme reserves the right to modify, suspend, or discontinue the referral programme at any time, and to reverse credits obtained through fraudulent or abusive means.
8. Intellectual Property
All intellectual property rights in the App, the SPLIT™ platform, and all associated content — including software, trademarks, logos, and design elements — are owned by or licensed to Evironme Limited.
Evironme grants you a limited, revocable, non-exclusive, non-transferable licence to use the App solely for its intended personal and non-commercial purpose. You may not copy, modify, distribute, reverse engineer, decompile, or attempt to extract the source code of the App.
9. Suspension & Termination
Evironme may suspend or terminate your access to the App if you:
• breach these Terms
• engage in fraudulent, abusive, or unlawful activity
• are required to be restricted by law or regulatory authority, or
• use the App in a manner that disrupts the experience of other users or the integrity of the Evironme network
Suspension or termination does not affect your obligation to pay for charging sessions already initiated or completed.
10. Limitation of Liability
10.1 As-Is Basis
The App is provided on an "as-is" and "as-available" basis. Evironme does not guarantee uninterrupted availability, accuracy, or error-free operation of the App or the charging network.
10.2 Excluded Losses
To the maximum extent permitted by Nigerian law, Evironme is not liable for indirect, incidental, special, or consequential losses arising from your use of the App, including loss of profit, loss of data, vehicle damage caused by third-party hardware or CPOs, or costs arising from unavailability of a charging station.
10.3 Liability Cap
Where liability cannot be excluded, Evironme's total liability is limited to the amount you paid through the App in the 12 months preceding the event giving rise to the claim, or ₦50,000, whichever is higher, unless mandatory Nigerian law requires otherwise.
11. Force Majeure
Evironme is not liable for failure or delay in performance caused by events beyond our reasonable control, including network outages, power failures, acts of government or regulatory authority, natural disasters, or failures of third-party systems or services.
12. App Store Providers
These Terms are between you and Evironme Limited only. Apple Inc. and Google LLC are not parties to these Terms and bear no responsibility for the App or its content. Any claims relating to the App are to be directed to Evironme, not to Apple or Google.
13. Governing Law & Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria.
13.2 Dispute Resolution
Any dispute arising from these Terms or your use of the App shall first be referred to Evironme for resolution through our customer support channels. Where a dispute cannot be resolved informally, it shall be submitted to the jurisdiction of the Nigerian courts.
14. Changes to These Terms
Evironme may update these Terms to reflect changes in law, our services, or our business operations. Material changes will be communicated through the App or via your registered contact details. Continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
